Foreclosure Defense
Our client, an elderly gentleman, retained us after his house was sold at a foreclosure auction. We were able to get the sale set aside over the strong objection of the bank. A new sale was ordered. That sale was also set aside (this time over the vehement objection of the bank). As a result, our client had the opportunity to move out of his property in an orderly fashion, rather than by force of a bank ejectment.
Construction
We have had several matters this year where homeowners have been the victims of unscrupulous builders. Because the builders were assetless, we were still able to get recoveries (limited to $15,000.00) from Connecticut’s Home Improvement Guaranty Fund, thus preventing our clients from total losses.
General Litigation
Our client, a notary, was accused of improperly notarizing documents. This resulted in her being sued by a person claiming that they suffered a loss as a result of the “wrongful” notarization. We were able to get the case dismissed on a summary judgment motion which ended what could have been a year-plus in litigation in just a few months.
Short Sales
We had a number of successful short sales this year. Our clients were able to shed their properties to third party buyers without further liability to their respective banks. In most of those cases, the banks paid all or substantially all of our clients’ fees associated with the sales.
Mediation
Mediation is a process where the parties to a dispute (typically one where suit has already been filed), agree to allow a third party (often a sitting or retired judge) assist them in settling the case. This process is voluntary, quick and often substantially cheaper that a fully litigated lawsuit. This year we were fortunate to settle all the cases that we submitted to mediation, which resulted in substantial savings and surety of results for all involved.
Trials
This year we had trials in Danbury, Litchfield, and Stamford, multiple appeals and defenses of appeal, and several litigated bankruptcy matters on behalf of creditors. In addition, we represented clients in many mediations and arbitration proceedings throughout the state.
